Protecting handicapped dependents

Raising and caring for a handicapped child can be a very trying experience for a family. The need for constant surveillance and attention, the continuous challenges that must be faced and the emotional suffering are a source of considerable fatigue and strain.

A handicap also raises social and legal issues and increases financial uncertainty. Having to deal with a handicap can often also cause families to focus exclusively on the present and neglect the future.

At the request of families with handicapped dependents, and in close cooperation with various associations that help the handicapped, Meeschaert Gestion Privée has developed an approach designed to meet the specific estate-planning challenges that the handicapped and their families must face.

 Wealth serving people

To help the handicapped and their families, Meeschaert Gestion Privée created a specieal Handicap & Estate Planning Department that seeks to ensure that each family's assets work for them as effectively as possible, in accordance with their specific requirements.

The first step is to identify objectives, for example:

- plan for the handicapped person's future, as the first and then the second parent passes away,
- allow as much autonomy as possible or plan for his or her legal protection,
- select an institution to provide care or enable the dependent to stay home,
- ensure financial independence,
- enable suitable leisure activities and holidays,
- strengthen protection for the surviving spouse,
- retain control over the estate,
- manage social assistance benefits,
- preserve family harmony and cohesiveness.

Facing the future with serenity

When planning a secure future for a handicapped dependent, while limiting the tax burden, Meeschaert Gestion Privée examines a variety of solutions (marriage contract, "de residuo" legacy, beneficial interests, life insurance, société civile, etc.) to determine what is best suited for the family's objectives and specific situation.

Once the legal framework is established, the management of financial resources is examined to ensure the best chance of achieving financial and therefore personal objectives.

How will income and expenditures evolve over the person's lifetime? How much capital or income will the child have when parents pass away? What is the optimum allocation between investments?

Although the future is inherently uncertain, with the right tools it is possible to estimate the impact of various choices on future financial resources. This makes it possible to adopt a strategy and provide the means that will be necessary to meet each family's needs.
